Work permit exemption services in Vietnam

Assess work permit exemption eligibility in Vietnam, identify confirmation or notification requirements and prepare evidence for the selected route.

Discuss your requirements

Identify the exemption basis first

Duong Tri Law helps employers and foreign personnel assess whether the facts support a work permit exemption and which administrative route applies. The review considers the individual, actual role, employer or host, work location, assignment dates and available evidence.

An exemption is not established by a job title, nationality, shareholder description or an overseas contract alone. The relevant category and its conditions must match the person’s actual circumstances. If the evidence does not support an exemption, the work permit route should be assessed.

Confirmation and notification are different routes

Exemption confirmation

Where the category requires confirmation, prepare the prescribed application and evidence supporting that exemption. The file and submission window must be checked before the proposed work begins.

Notification for specified categories

Some categories follow a notification procedure instead of obtaining a confirmation certificate. Exemption from the certificate procedure does not remove the applicable notification and record-keeping requirements.

Situations that need an individual assessment

  • An owner, capital-contributing member or board member: check the exact legal capacity, qualifying investment and supporting corporate records.
  • An intra-company transferee: check the overseas employment history, Vietnam commercial presence, activity and assignment evidence.
  • A short work assignment: check the role and relevant aggregate time limits, rather than relying on the length of one trip.
  • A person married to a Vietnamese citizen: assess the marriage, residence facts and applicable confirmation route.
  • A person establishing a commercial presence or working under a specific programme: check the appointment, purpose and category-specific evidence.

These are screening situations, not a complete list or an eligibility determination. The assessment should record the exact basis relied on and any factual gaps.

Build a checklist for the selected route

Employer or host

Entity details, authorised signatory, work locations, intended role, work arrangement and start/end dates.

Individual

Passport details and current immigration position, with photographs, health records or other prescribed documents where required for the procedure.

Exemption evidence

Corporate investment records, assignment and employment evidence, family records or programme documents relevant to the claimed category.

Foreign documents

Identify legalisation or exemption from legalisation, translation and certification requirements before commissioning documents overseas.

The confirmation application and a notification do not have identical document requirements. The final checklist follows the selected procedure and the current receiving-authority requirements.

From initial review to agreed next steps

  1. Assess the facts

Confirm the intended work and identify the precise exemption category or the need to review a work permit.

  2. Confirm the administrative route

Determine confirmation or notification, receiving authority and the filing timetable for the actual location and start date.

  3. Prepare and submit within scope

Align names, passport details, role and dates; prepare agreed forms and supporting records and respond to clarification requests.

  4. Record the outcome and next steps

Check the result or notification evidence and record validity, changes and any further work-authorisation or residence action required.

Plan before the work starts

Provide the intended start date at the first discussion. Preparation may involve overseas documents and employer records, while the applicable filing window and processing period depend on the route. A processing period should not be treated as the total lead time.

Changes to the employer, work, location, passport or underlying exemption facts require a fresh review. Immigration and residence arrangements remain separate: an exemption from a work permit does not by itself establish eligibility for a temporary residence card.

Fees are confirmed after the category and document position are reviewed. The scope should distinguish legal service fees, official charges where applicable, translation, certification and other third-party costs.

Questions before you proceed

Does every exempt worker need a confirmation certificate?

No. The rules distinguish categories requiring confirmation from specified notification cases. The exact category determines the procedure.

Does owning a company automatically establish exemption?

No. The person’s legal capacity, qualifying investment and evidence need to satisfy the relevant category. Indirect ownership or a title alone is not enough to conclude eligibility.

Can we use the same paperwork for every employee?

No. Employer details may be reusable, but each person’s basis, role, dates and evidence must be assessed individually.

Can an exemption replace immigration paperwork?

No. Coordinate employment authorisation with the person’s visa and residence position. Each has its own conditions and supporting records.

Legal framework and procedure references

The applicable provisions, receiving authority and document requirements must be checked for the facts and filing date of each case.
